These Terms & Conditions ("Terms") govern your use of mySTAXX, including our platform and shop at mystaxxai.com and shop.mystaxxai.com (together, the "Services"), operated by mySTAXXai ("mySTAXX," "we," "us," "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Earnings & Results Disclaimer: mySTAXX sells educational content, tools, and a project-showcase platform. We do not sell business opportunities, investments, or guaranteed income programs. Any reference to income, results, or success is not typical and is not a guarantee of what you will achieve.

1. Description of Services

mySTAXX provides:

  • A platform allowing users to showcase AI projects, tools, and skills on a personal landing page/portfolio
  • A shop offering digital products, including guides, ebooks, and related content, for purchase

2. Accounts

If you create an account on the platform, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and notify us of any unauthorized use of your account.

3. Digital Products & Purchases

  • All purchases through shop.mystaxxai.com are for digital products, delivered electronically.
  • Prices are listed in USD unless otherwise stated and are subject to change without notice.
  • Refund Policy: All sales are final. Due to the digital nature of our products, we do not offer refunds once a purchase is completed. If you have a subscription or recurring product through mySTAXX and choose to cancel, your cancellation will take effect at the end of your current billing period — you will retain access until that period ends, and you will not be charged for the next renewal. No partial refunds are issued for unused time within a billing period.
  • You may not resell, redistribute, or share purchased digital products without our written permission.

4. User-Generated Content

If the platform allows you to upload or add content (projects, descriptions, links, images), you retain ownership of that content, but grant mySTAXX a non-exclusive, royalty-free license to display it as part of the Services.

You are solely responsible for the content you post and confirm that it does not violate any third party's rights or applicable law. We reserve the right to remove content that violates these Terms.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Services
  • Upload malicious code, spam, or content that infringes on others' rights
  • Misrepresent your identity or affiliation
  • Interfere with the normal operation of the Services

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Intellectual Property

All mySTAXX branding, logos, design, and platform content (excluding user-generated content) are owned by mySTAXX and may not be used without permission. Digital products sold through the shop are licensed for personal use as described at the time of purchase, not resold or redistributed unless explicitly stated.

7. Third-Party Services

The Services rely on and may link to third-party providers, including Shopify, Supabase, Anthropic, Resend, and Vercel. We are not responsible for the practices, content, or availability of third-party services.

8. No Guarantees

We do not guarantee any specific outcome, result, or level of performance from your use of the Services. This includes, without limitation:

  • No guaranteed income or results. Nothing in our guides, products, platform, or communications is a promise or guarantee that you will earn any specific amount of money, achieve any particular skill level, or achieve any particular outcome from using AI tools, building projects, or following our content. Any examples, testimonials, or figures referenced are illustrative only, not typical or guaranteed results.
  • No guaranteed uptime or availability. We do not guarantee the Services will be available at all times, uninterrupted, or free from errors, bugs, or downtime.
  • No guaranteed compatibility. We do not guarantee the Services will work with any particular device, browser, or third-party tool.
  • No guaranteed data security. While we take reasonable security measures, we do not guarantee that data will never be lost, breached, or accessed without authorization.
  • Not professional advice. Nothing on the platform, in our products, or in any communication from us constitutes legal, financial, tax, or professional business advice. You are solely responsible for your own decisions.
  • Use at your own risk. Your use of the Services, any AI-generated content, and any code, guidance, or output provided through the Services is entirely at your own risk.

THE SERVICES AND ALL CONTENT, PRODUCTS, AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(a) mySTAXX, its owners, employees, and affiliates SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Services.

(b) In no event shall mySTAXX's total cumulative liability to you for all claims arising from or related to the Services exceed the greater of (i) the total amount you paid to mySTAXX in the twelve (12) months preceding the claim, or (ii) one hundred dollars ($100 USD).

(c) These limitations apply regardless of the legal theory on which a claim is based (contract, tort, negligence, strict liability, or otherwise) and even if mySTAXX has been advised of the possibility of such damages.

(d) Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless mySTAXX, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any content you submit, post, or transmit through the Services.

11. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Class Action Waiver: You and mySTAXX agree that any arbitration or proceeding shall be limited to the dispute between us individually. You waive any right to participate in a class action, class arbitration, or representative action.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to jmlprojectx@gmail.com within 30 days of first accepting these Terms.

Arbitration clauses have specific legal requirements that vary by state and country (some jurisdictions, including California, require specific disclosures or don't permit certain class-action waivers in consumer contracts). Have an attorney confirm this section is enforceable in your jurisdiction before relying on it.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to mySTAXX or other users.

13. Governing Law

These Terms are governed by the laws of New York, United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
